Summary:

The ASPCA is seeking an experienced regulatory attorney with excellent legal and technical writing skills to join our staff as Legal Advocacy Regulatory Counsel (“Counsel”). This role represents an exciting opportunity to significantly improve legal protections for animals and the potential to see how your work can impact animal policy at a national level.

Counsel will work under the supervision of the department’s Senior Counsel and will provide legal support and policy guidance to other ASPCA departments to improve legal protections for animals and ensure that the organization’s regulatory work is consistent with the policies, positions, and organizational goals of the ASPCA.

Our Legal Advocacy team also provides “Second Chair” legal assistance to prosecutors, police, and cruelty investigators around the country to help ensure successful prosecution of animal cruelty and fighting cases.

This remote-based position (which requires travel, as described below) is open to all candidates based within the United States. Counsel may work from a home office anywhere in the country or from the ASPCA’s 8th Avenue office in New York City. Candidates based within commuting distance of New York City will be expected to commute to our New York City 8th Avenue office once a week.

Responsibilities:

Responsibilities will include, but are not limited to:

Department Advising (60%)

  • Under the supervision of Senior Counsel, serve as legal counsel to the Government Relations team and other departments engaged in regulatory work
  • Evaluate and provide assessments of regulations proposed by relevant agencies
  • Draft internal memos and recommendations concerning proposed regulations
  • Draft petitions for rulemaking, proposed regulations, regulatory comments, legislative/regulatory testimony, and other communications with federal and state agencies
  • In coordination with other members of the department, draft and submit FOIA requests and appeals, track agency responses and response times, and connect with federal and state agencies to obtain timely responses.

Identification of Litigation Opportunities (30%)

  • Assume substantial responsibility for proactively identifying litigation opportunities arising out of regulatory matters and FOIA requests and for developing and litigating such cases
  • Review and analyze regulations affecting animal welfare
  • Identify and track regulatory developments in the animal welfare field and assist with establishing the organization’s regulatory priorities and strategy

Program Administration (10%)

  • Collect and report program data
  • Assist in supervision of pro bono counsel and legal interns
  • As time permits, Counsel may also assist with other legislative research and analysis, civil litigation, amicus curiae briefs, and criminal cases.
  • Assist the department’s “Second Chair” program, which provides legal support to other ASPCA departments and local law enforcement and prosecutors involved in animal cruelty and fighting cases.

Education:

  • Juris Doctor Degree required

Experience:

  • Minimum of three (3) years of experience with regulatory law and litigation.

Additional Information:

  • On call availability (evenings and weekends)
  • Admission to the bar in at least one state required
  • Admission to practice in at least one federal court required
  • Moderate (~10%) travel required (Please note, travel requirements may be modified temporarily due in part to COVID-19; this remains a requirement of the position, and we expect normal travel volume to resume as the organization resumes normal operations)
  • Candidates selected to advance in the interview process will be required to submit a writing sample

Qualifications:

Ability to work under pressure in a fast-paced environment, Excellent communication and negotiation skills, Excellent legal writing, research, and oral advocacy skills, Experience working for or with one or more federal regulatory agencies preferred, Familiarity with the Animal Welfare Act and national animal welfare issues, Strong computer skills (including familiarity with Word, Excel, PowerPoint, document organization and deposition summary software), Working knowledge of the Administrative Procedures Act and the Freedom of Information Act
